Pursuant to notice of meeting duly given, the Planning and Zoning Commission convened on Wednesday, February 21, 2007, at Kirkwood City Hall.  City Attorney John Hessel, Public Works Director Kenneth D. Yost, Assistant City Engineer Todd Rehg, and Administrative Secretary Patti Dodel also attended the meeting. 

1.   Chairman Waltz called the meeting to order at 7:03 p.m.  Mr. Bliss was absent and his absence was excused. 

2.   Motion was made by Mr. Ross and seconded by Mr. Frick to approve the minutes as written for the February 7, 2007, meeting.  The motion was unanimously approved by the members present (Mr. Bliss was absent).

3.   PZ-26-07  SPECIAL USE PERMIT (CONTRACTOR’S YARD) AND SITE PLAN REVIEW - KIRKWOOD MASONRY, 404 EAST ELLIOTT

     Submitted:  12-29-06  Automatic Recommendation Date:  4-28-07

     Petitioner, Daniel Head

     (Subcommittee - Mr. Soraghan and Mr. Bliss)

     Daniel Head had advised the City he would be submitting a revised site plan by the end of the month. 

4.   PZ-31-01  SPECIAL USE PERMIT (RESTAURANT) - POPtions, 200 SOUTH KIRKWOOD ROAD

Mr. Freundlich was present. Motion was made by Mr. Frick and seconded by Mr. Roeser to approve the petition for a special use permit for a restaurant in Suite 100 at 200 South Kirkwood Road.  Mr. Osborn read the subcommittee report recommending approval:

DESCRIPTION OF PROJECT:

The petitioner is proposing to occupy the space adjacent to Mavrik Jewelry on Madison Avenue.  Popcorn will be made on the premises and flavored with spices and sweeteners.  Fountain drinks and bottled drinks (non alcoholic) will be offered.  Seating will be provided for approximately 12 patrons inside the building.  Any outdoor seating shall be considered an accessory use (seating for 12 or less) on the existing pavement. 

COMPREHENSIVE PLAN & LAND USE:

This site is designated for Mixed Use on the Vision 2015 Future Land Use Plan map.  This proposal is consistent with the Vision 2015 Comprehensive Plan.  

DISCUSSION:

A Zoning Matters signs was posted on the property January 31, 2007.  The petitioner presented his plan at the February 7, 2007, Planning and Zoning Commission meeting; discussion was held; and a subcommittee was appointed.  The Subcommittee met on the site February 13, 2007, with Andrew Freundlich and Laura Swifford.  Notice of the meeting had been properly posted.

RECOMMENDATION:

The subcommittee recommends that the City Council grant a Special Use Permit on the property known as 200 South Kirkwood Road, Suite 100 for a restaurant as provided for in Appendix A, Article IX, Section A-61 in the Code of Ordinances subject to the following condition:

1.   Any outdoor seating shall meet the requirements of  the Zoning Code, Section A-3(b)(89).

2.   The Architectural Review Board shall approve all signs and exterior modifications prior to issuance of a sign permit.

3.  The premises and improvements as approved by this ordinance shall be in good working order and maintained in good repair at all times.

     The motion to approve the petition was unanimously approved by the members present (Mr. Bliss was absent).  Motion was made by Mr. Soraghan and seconded by Mr. Roeser to approve the subcommittee report as read.  Unanimously approved by the members present (Mr. Bliss was absent).

5.   THREE-YEAR REVIEW OF COMPREHENSIVE PLAN

     (Subcommittee - Mr. Waltz, Mr. Osborn, Ms. Starr, and Mr. Frick)

     Motion was made by Mr. Frick and seconded by Ms. Starr to approve the final draft of the City of Kirkwood Comprehensive Plan Vision 2015 Review dated January 8, 2007, prepared by Permit Consultants with attached revisions on Special Focus Areas.

     Motion was made by Mr. Soraghan and seconded by Mr. Ross to delete “While a detailed planning effort is beyond the scope of this review, it is highly recommended that the city pursue a comprehensive study of the corridor area to be conducted by land use and economic development consultants working through city staff with continued citizen input.  Any study should consider all public comments made in conjunction with the Planning and Zoning Commission subcommittee’s work in 2006” from Revised Page #25.  Motion passed seven to one (Mr. Frick was opposed and Mr. Bliss was absent). 

     Motion was made by Ms. Starr and seconded by Mr. Soraghan to delete “Commercial development pressures are again intensifying in this area” from Revised Page #25.  Motion passed six to two (Mr. Roeser and Mr. Osborn were opposed and Mr. Bliss was absent).

     Motion was made by Mr. Soraghan and seconded by Mr. Frick to replace the first paragraph of Revised Page #28 with “This frontage section of Big Bend is part of the larger, triangular area addressed by Goal #9 that is bounded by Kirkwood Road, Big Bend, and the BN railroad tracks.  Accordingly, consideration of future development of Big Bend Area #2 will be included in any future study of the Goal #9 area.”  Motion passed five to three (Mr. Frick, Mr. Waltz, and Mr. Osborn were opposed and Mr. Bliss was absent).

     Motion was made by Mr. Frick and seconded by Ms. Starr to approve the final draft of the City of Kirkwood Comprehensive Plan Vision 2015 Review dated January 8, 2007, prepared by Permit Consultants with attached revisions on Special Focus Areas as amended.  Motion was unanimously approved.

6.   PZ-30-07  SITE PLAN REVIEW - CONCORDIA LUTHERAN CHURCH, PARKING LOT AT 504, 508, 520 SOUTH CLAY & 129 IDLEWILD

     Submitted:  2-2-07   Automatic Recommendation:  6-2-07

     Petitioner’s Agent, Mark Doering

     John King, attorney representing Concordia Lutheran Church (CLC); Carl Rausch, President of Lutheran Senior Services; Tom Siener, CLC Facility Manager; and Mark Doering, Doering Engineering; were present.  Mr. King stated CLC, which is located on the southwest corner of Kirkwood Road at Woodbine Avenue, is proposing to demolish three single-family residences and construct two additional parking lots with access from Clay Avenue. CLC attempted to purchase two residences on Clay Avenue that are surrounded by the proposed parking lot. The two houses are owned by the same individual and rented.  Front yard setback variances would be required.    

     Mr. Doering commented it would be difficult to connect the proposed lots to the existing lot due to the difference in grade. 

     Chairman Waltz appointed Ms. Starr (Chairman) and Mr. Golterman (Secretary) to the subcommittee.

There being no further business, the meeting adjourned at 8:05 p.m.  The next meeting is scheduled for March 7, 2007, at 7:00 p.m.
