  Board of Adjustment Minutes

Kirkwood City Hall Council Chambers, 139 S. Kirkwood Rd, December 10, 2007 – 7:00 P.M

Present:  Gerald DeWulf, Chairman, Susan Waters, James Myers, Lynn Allen and Norella Huggins

City Attorney:  Andrew Buchanan

Staff Member Present: Tony Carvalho

The meeting was called to order and roll called.  Board procedure was explained and minutes from the previous meeting were approved without change. Cases were then called as follows:

Old Business

Case No. 49-2007 Core 10 Architecture, applicant, Richard McClure & Sharon Buchanan-McClure, owner of 145 E. Essex Avenue (R-3 Zoning District) wishes to attach an existing detached garage to an existing single-family residence that will not conform to the rear yard setback of the Zoning Ordinance. Unanimously approved with exception:  Conditional and subject to the limitation that any structure built within 35 feet of the rear yard property line may not exceed a single story, may not be used for living quarters and may not exceed the height of the current detached garage.

New Business

Case No. 50-2007  Thomas Hizar, applicant/owner of 420 Dickson St, (R-3 Zoning District) wishes to construct a portico that will not meet the south side yard setback of the Zoning Ordinance.  Unanimously approved

Case No. 51-2007 Dennis & Sheila Thompson, applicant/owner of 18 E. Glenwood Ln. (R-3 Zoning District) has constructed a shed/playhouse that does not meet the rear yard setback of the Zoning Ordinance.  Unanimously approved

Case No. 52-2007 Jeff Mugg of St. Louis Design Alliance, Inc., applicant. Michael & Elizabeth Gibbons, owner of 214 & 218 N. Clay Ave. (B-2 Zoning District) request variance from the required number of parking spaces of the Zoning Ordinance.  Unanimously approved

Case No. 53-2007  Michael Lewis, applicant/owner of #4 Churchill Ln.(R-3 Zoning District) wishes to construct an attached garage that will not meet the front and side yard setbacks of the Zoning Ordinance. Denied with vote of 3-2

Case No. 54-2007  CDF & CNF Investments, LLC, applicant/owner of 1113, 1119, 1120, 1123 & 1125 Earl Ave., 10921 & 10939 Manchester Rd. (R-4 & B-3 Zoning District) request variance from the required number of parking spaces and variance from the required front parking lot setback requirement of the Zoning Ordinance. Front parking lot setback requirement – unanimously approved; Variance from the required number of parking spaces –unanimously denied.
