  Board of Adjustment Minutes

Kirkwood City Hall Council Chambers, 139 S. Kirkwood Rd, September 10, 2007 – 7:00 P.M

Present: Gerald DeWulf, Chairman, Norella Huggins, Susan Waters, Ken Green, and James Myers

City Attorney:  Andrew Buchanan 

Court Reporter:  Linda A. DeBisschop

Staff Member Present: Tony Carvalho

The meeting was called to order and roll called.  Board procedure was explained and minutes from the previous meeting were approved without change. Cases were then called as follows:

New Business

Case No. 37-2007  Don Jordan, applicant/owner, of 400 Whitson Avenue, (R-4 Zoning District) wishes to construct a new single-family residence that will not conform to the front yard setback of the Zoning Ordinance.  Unanimously approved

Case No. 38-2007 Laura Neri Baebler, applicant, The Royal Arm, LLC, owner of 483 N. Kirkwood Road (R-5 Zoning District) wishes to construct a new multi-family dwelling that will not conform to the front yard setbacks along N. Kirkwood Rd. and W. Bodley Ave.; variance for parking spaces in the required front yard and variance for parking spaces not having direct access to a street.  Parking without direct access to street – unanimously denied; Parking space within the required front yard – unanimously denied; Front-yard variance along N. Kirkwood Rd. – denied with a vote of 2-3; Front-yard variance along W. Bodley Ave. – denied with a vote of 2-3.

Case No. 39-2007 Don Anderson of Adams Street Architectural Design, applicant, Jim & Amy Studt, owner of 342 W. Madison Avenue (R-5 Zoning District) wishes to screen-in portion of existing wrap-around porch that will not conform to the front yard setback of the Zoning Ordinance along S. Van Buren Ave.  Unanimously approved

Case No. 40-2007 Padaman, applicant/owner of 10545 Big Bend Road (R-5 to B-1 Zoning District) wishes to create a parking spaces that will not conform to the front yard setback of the Zoning Ordinance.  Unanimously approved

Case No. 41-2007  Dan & Angie McAlone, applicant/owner of 445 N. Taylor Avenue (R-3 Zoning District) wishes to construct an attached garage that will not conform to the side yard setback of the Zoning Ordinance.  Unanimously denied
