  Board of Adjustment Minutes

Kirkwood City Hall Council Chambers, 139 S. Kirkwood Rd, August 13, 2007 – 7:00 P.M

Present:            Gerald DeWulf, Chairman, Norella Huggins, Ken Green, James Myers, and Laura Gerdes Long

City Attorney:  Jason Sapp 

Court Reporter:  Pamela Needham

Staff Member Present: Tony Carvalho

The meeting was called to order and roll called.  Gerald DeWulf was voted in to resume his position as Chairman for another year. Susan Waters was voted in as Secretary. Board procedure was explained and minutes from the previous meeting were approved without change. Cases were then called as follows:

New Business

Case No. 32-2007  David Schaub applicant/owner, of 1045 N. Harrison Avenue, (B-3 Zoning District) wishes to request a front yard variance for parking lot and variance from planting buffer strip requirement, variance to allow a new office building to be erected on a lot not meeting the minimum square footage and a front building line less than the required width. Unanimously approved – 5 variances

Case No. 33-2007 Ed Bier, applicant, Paula Huberman, owner of 432 S. Clay Avenue (R-5 Zoning District) wishes to construct a fence in a front yard that exceeds maximum height requirement and less than one-third open.  Height requirement unanimously approved

Case No. 34-2007 Ed Bier, applicant, Celeste Kososki, owner of 456 S. Clay Avenue (R-5 Zoning District) wishes to construct a fence in a front yard that exceeds maximum height requirement and less than one-third open.  Height requirement unanimously approved

Case No. 35-2007 William James Fears, applicant/owner of 1115 N. Geyer Rd. (R-3 Zoning District) wishes to create a parking space that will not conform to the front yard setback of the Zoning Ordinance. Unanimously approved

Case No. 36-2007  Mary Bendel of Benchmark Developers, applicant/owner of 446 Miriam Avenue (R-3 Zoning District) wishes to construct a new single-family residence that will not conform to the front and rear yard setbacks of the Zoning Ordinance.  Unanimously denied. Withdrew front yard variance request.
