  Board of Adjustment Minutes

Kirkwood City Hall Council Chambers, 139 S. Kirkwood Rd, July 9, 2007 – 7:00 P.M

Present:            Gerald DeWulf, Chairman, Norella Huggins, Ken Green, Susan Waters. Carol Gilster and Lynn Allen

City Attorney:  Andrew Buchanan & Jason Sapp 

Court Reporter:  Sally A. Barach

Staff Member Present: Tony Carvalho

The meeting was called to order and roll called.  Board procedure was explained and minutes from the previous meeting were approved without change. Cases were then called as follows:

New Business

Case No. 26-2007 Daniel Allen applicant/owner, of 435 Gill Avenue, (R-3 Zoning District) wishes to create a parking space that will not conform to the front yard setback of the Zoning Ordinance. Unanimously approved

Case No. 27-2007 Pam Mayberry & Art Harper, applicant/owner of 205 Smith Street (R-3 Zoning District) wishes to construct a carport that will not conform to the side yard setback of the Zoning Ordinance. Unanimously approved

Case No. 28-2007 Anthony Duncan Architect, applicant, Kip Levine, owner of 225 Avery Drive/1150 N. Harrison Avenue (R-4 Zoning District) wishes to construct two new single-family residences that will not conform to the front yard setbacks along Avery Drive and Harrison Avenue of the Zoning Ordinance. Withdrew request for a front yard variance on Avery; Front yard variance on Harrison– unanimously disapproved

Case No. 29-2007 James & Peggy Reinert applicant/owner of 624 S. Ballas Road (R-3 Zoning District) wishes to construct a new single-family residence that will not conform to the front yard setbacks along S. Ballas Road and Thursby Avenue of the Zoning Ordinance. Unanimously approved

Case No. 30-2007 Larry Wurm of James Engineering & Surveying Co., applicant, B. Harley Construction, Inc., owner of 1157 Simmons Avenue (R-4 Zoning District) wishes to construct a new single-family residence that will not conform to the front yard setback of the Zoning Ordinance. Unanimously approved

Case No. 31-2007  Donald Anderson of Adams Street Architectural Design, applicant, Mike Mahn of Kirkwood Renovations, owner of 639 E. Jefferson Avenue (R-3 Zoning District) wishes to construct a new single-family residence that will not conform to the front and side yard setbacks and construct an addition to an existing detached garage that will not conform to the rear yard setback of the Zoning Ordinance. Front yard and Rear yard variance – unanimously approved; Side yard variance – unanimously denied.
