  Board of Adjustment Minutes

Kirkwood City Hall Council Chambers, 139 S. Kirkwood Rd, April 9, 2007 – 7:00 P.M

Present:            Gerald DeWulf, Chairman, Ken Green,  Norella Huggins, Jason Weissenburger and  Susan Waters

City Attorney:  Andrew Buchanan  

Court Reporter:  Margaret Clodius

Staff Member Present: Kenneth Yost

The meeting was called to order and roll called.  Board procedure was explained and minutes from the previous meeting were approved without change. Cases were then called as follows:

New Business

Case No. 08-2007 Steven & Brenda Leathers of 11204-11224 Big Bend Road (Existing R-3 Proposed B-3 Zoning District) wishes to construct a commercial retail/office building that will not conform to the front yard setback of the Zoning Ordinance.  City Council denied rezoning – variance request not heard.  Moot issue. 

Case No. 09-2007 Daniel Terpstra of 1508 Greening Lane (R-2 Zoning District) wishes to construct a two-story porch that will not conform to the front yard encroachment of the Zoning Ordinance.  Unanimously approved

Case No. 12-2007 John & Gwen Crafton of 602 McLain Lane (R-3 Zoning District) wish to create a parking space that will not conform to the front yard setback of the Zoning Ordinance.  Unanimously approved

Case No. 11-2007  Central Place Properties, Robert Ferber of 337 S. Fillmore Avenue (Existing R-4 Proposed R-5 Zoning District) wish to construct a new multi-family project that will not conform to the front yard setback of the Zoning Ordinance. Unanimously approved

Case No. 13-2007 Randy Johnston and Beth Fitzgerald of 516 S. Kirkwood Road (R-5 Zoning District) wish to create parking spaces that will not conform to the front yard setback of the Zoning Ordinance, request variance from the required number of parking spaces and wishes to construct a building structure that will not conform to the height requirements of the Zoning Ordinance.  Height variance and North front yard parking variance – unanimously approved; Variance on required number of parking spaces – unanimously denied.
