The City Council meets at 7:00 p.m. on
the first and third Thursday of each month at Kirkwood City Hall, 139
South Kirkwood Road. The public is invited to attend. A time for public
comments is provided for at the beginning of each meeting. The agendas for

City
Clerk Betty Montano:
The
City Clerk is appointed by the Mayor and City Council. The
City Clerk prepares the agenda for City Council meetings and
maintains records for the council. In addition, the City Clerk
provides tours of City Hall and Council Role Plays for area
student groups upon request. One of the most important
functions of the City Clerk is to serve as a direct contact
with residents wishing to express concerns about city services
or issues. In this capacity, the City Clerk acts as an
impartial conduit in relaying these concerns to the City
Council and ultimately to the appropriate staff member for
resolution.

Listed below are some recent laws that have been passed by the
Kirkwood City Council and some laws that are not so new.
ANIMALS
DISTURBING NOISES
PROPERTY MAINTENANCE CODE
TOBACCO -- MINORS IN POSSESSION
Animals:
Sec. 4-3.
Abandonment of Animals. Except as otherwise
authorized in the Code, no person shall release, abandon or
leave any animal in any place without making provisions for
its adequate care or without the apparent intent to recover or
resume custody of the animal.
Sec. 4-5.
Keeping more than three cats to constitute a nuisance;
exception. Keeping more than three cats constitutes a nuisance and shall
be subject to the procedures established in the Code for
abatement of nuisances, except on those occasions of the birth
of a litter of cats, in which event, the litter may be kept
together with their mother until they reach the age of two (2)
months.
Sec. 4-30.
Maximum number of dogs which may be kept.
No person shall keep or house on his premises or the
premises of others within the city, more than three dogs,
except upon the occasion of the birth of a litter of dogs,
when the litter may be kept together with their mother until
they reach the age of six months and shall be weaned from
their mother.
Sec. 4-33
Animal Waste removal by owner.
It is unlawful for any person owning or in control of
any animal to allow or permit such animal to defecate upon any
public property, street right-of-way, alley, sidewalk,
condominium for subdivision common area or private property or
another, unless the person owning or in control of the animal
immediately removes and properly disposes of all waste
deposited by the animal.
The City Council passed this law to allow residents an
opportunity to file a complaint at the Police Department.
Animals at Large. Any
cat shall be deemed at large when off the premises of its
owner’s real property and 1) not wearing a collar with
appropriate tags attached, and 2) when creating a public
nuisance.
Any dog shall be deemed at large when off the premises
of the owner’s real property and 1) not restrained by a
competent person, or 2) when creating a public nuisance.
Any dog is considered under restraint if it is
controlled by a line or leash not more than six (6) feet in
length, when said line or leash is held by a competent person,
that is, a person capable of controlling or governing the dog
and to whose commands the dog is obedient.
Public Nuisances:
A dog or cat is creating a public nuisance if:
a.
molesting passerby or passing vehicles;
b.
attacking other animals
c.
trespassing on school grounds
d.
damaging public or private property
e.
barking, whining, howling, meowing excessively or
continuously

Disturbing
Noises:
Sec.
17-36.
Disturbing noises prohibited. It shall be
unlawful for any person to make, continue or cause to be made
or continued any loud, unnecessary or unusual noise or any
noise which unreasonably or unnecessarily either annoys,
disturbs, injures or endangers the comfort, repose, health,
peace or safety of others in the city.
The provisions of this section shall not apply to or be
enforced against:
a)
any vehicle of the city while engaged in public
business.
b)
excavations or repairs of streets by or on behalf of
the city, county, or state at night when public welfare and
convenience renders it impossible to perform such work during
the day.
c)
the reasonable use of amplifiers or loudspeakers in the
course of public addresses which are noncommercial in
character.
Sec.
17-37.
Conduct constituting disturbing noises.
There are several activities that are considered in
this section of the code, such as: radios, televisions,
loudspeakers, yelling, shouting, animals, etc.
Construction
and repair work:
The exterior construction, demolition, alteration or
repair of buildings involving the operation of machinery or
equipment which causes loud or disturbing noise except between
the hours of 7 a.m. and 8 p.m. on Monday through Saturday and
between the 9 a.m. and 8 p.m. on Sunday, and except for
activities by governmental authorities or public utilities
when the activities are in response to emergencies or
otherwise in the interest of public health and safety.
Property
Maintenance Code:
This
code provides the City of Kirkwood with an effective
regulatory means of providing minimum health and safety
requirements for existing buildings and structures.
The Property Maintenance Code addresses things such as:

Occupancy Permits
·
Compliance related to the condition and
maintenance of the exterior property and structure
·
Compliance with the applicable provisions
related to the conditions and maintenance of features
essential to health and sanitation for the interior structure
areas
Weeds:
Property owners are responsible for maintaining the
property they own. There
are provisions in the Code that stipulate that if weeds grow
in excess of 8 inches it is a violation of the nuisance code.
Tobacco
– Minors in Possession of Tobacco Products:

It shall be unlawful for anyone to sell or
distribute any tobacco product or rolling papers to any minor.
·
No person 17 years of age or under shall
purchase, attempt to purchase or have in his/her possession
any cigarettes, cigarette wrappers or tobacco products
(cigars, pipes, chewing tobacco, snuff, etc) within the City
limits.
This legislation prohibits anyone from
selling a minor any type of tobacco product or rolling papers
and makes it unlawful for any minor to be in possession of any
tobacco products or rolling papers.

and where does the city council meet?
The City Council meets on the 1st and 3rd Thursdays of the
month at 7:00 p.m. in the Council Chamber (2nd floor) at City
Hall, 139 S. Kirkwood Road. City offices are open for business
Monday –
Friday from 8:00 a.m. to 5:00 p.m.
Who is my council person?
The City of Kirkwood does not have wards, therefore, the 7
member council is elected at large and represents all Kirkwood
residents. Currently, the council is made up of Gerry
Biedenstein, Joe Godi, Tim
Griffin, Gina Jaksetic, Paul W. Ward, Iggy Yuan and Mayor Art
McDonnell.
What are the
terms of the council?
The Mayor and City Council are limited to two consecutive 4-
year terms. The terms are staggered so that not all of the
members are up for re-election in the same year.

I speak at council meetings and public hearings?
City Council meetings are open to the public and an
opportunity for citizen comments is part of the agenda. At that
point citizens may address the council concerning any issue but
we request that comments be limited to three minutes per person.
There are also opportunities to speak during public hearings
after the petitioner has presented the issue to the City
Council.
How
can I be appointed to a Board or Commission?
The council makes appointments when there are vacancies on
boards and commissions. You can express your interests and
qualifications by contacting city clerk Betty Montano at
822-5802 and requesting a Volunteer Profile Form or download

Can
I get married at the city hall in Kirkwood?
No. You may obtain a marriage license in Clayton where they
are also able to perform civil ceremonies. Call 889-2180 for
more information.
Do
you have a notary I may use?
City notaries are used for official city business only. Contact
your bank to see if they offer notary services to their
customers.
Voter
Registration Information
You can register to vote by stopping by
City Hall, located at 139 South Kirkwood Road, between normal office
hours of 8 a.m. and 5 p.m. Monday through Friday. We encourage you to
visit the St. Louis County Board of Election Commissioner's website
to learn more about deadlines for registering to vote, absentee voting,
polling place locations, and valid forms of identification required in
order to register to vote.
